Mel Gibson faces ex-girlfriend again in battle for baby Lucia

Los Angeles, California (CNN) -- Mel Gibson and his ex-girlfriend, Oksana Grigorieva, agreed on something Monday: how to dress for battle.

The actor and the mother of his 1-year-old daughter, Lucia, both wore dark sunglasses, black business suits and emotionless expressions as they walked into a Los Angeles courtroom for a child custody hearing.

Since reporters were dismissed soon after Judge Scott Gordon called their case, it is unknown if the former couple agreed on anything else. It would be unexpected, judging from their split earlier this year.

Grigorieva was on the stand Monday morning, while her mother and the woman who works for Gibson as the baby's nanny were waiting to testify in the afternoon session.

Gibson and Grigorieva last met in the same courtroom on November 10 for a daylong hearing that included squabbles over attorneys' fees, child support and whether they should be allowed to talk freely to the media about the family law case.

Gordon stopped sort of imposing a gag order, but Gibson's lawyers have followed a self-imposed silence, citing routine confidentiality requirements in a family law case.

Grigorieva, a Russian musician, decided to talk publicly -- to CNN's Larry King -- about her claims of domestic violence by Gibson.

The public has already heard several recordings of angry Gibson phone calls to Grigorieva, but she told King she did not give them to celebrity news website Radaronline.

Details about the case have flowed at a steady pace on celebrity news website TMZ over the past two weeks. Hundreds of pages of sealed court documents were somehow leaked, including affidavits, deposition transcripts and dental records.

Even beyond the family law case, two related criminal investigations are under way.

The Los Angeles County district attorney is considering evidence gathered by sheriff's investigators to decide if a domestic violence case will be made against Gibson, according to a spokeswoman for the prosecutor.

Detectives are also investigating Gibson's charge that Grigorieva tried to extort him with phone recordings she made of his calls, a sheriff's spokesman said.

Photos, or more accurately video screen grabs of Mel Gibson's daughter Lucia offer proof that the actor did not abuse the infant, according to his legal team.

Shot three days after the fight between Mel and Oksana Grigorieva during which she says he abused them, Gibson says the video proves she's a perjurer.

Oksana claims that during a Jan. 6 argument, Mel hit her twice, and the second blow grazed Lucia, drawing blood and creating an abrasion on her chin.

Will photo evidence clear Mel Gibson of domestic abuse charges?

Oksana Grigorieva submitted a photo in the custody case purporting to show Lucia's injury. But video from January 9 shows absolutely no evidence of an abrasion.

According to court documents, Mel's lawyers claim Oksana doctored the photo to prove a phantom injury - basically they say she's lying about Mel Gibson's abuse.

Mel admits he slapped Oksana January 6, but says it was one time, not hard, and only done to "bring her back to reality" because he feared she would hurt Lucia.

The day after the confrontation, Oksana took Lucia to her pediatrician, and made no mention of an injury, nor did the pediatrician see one. Very suspicious stuff.

That's the sound of whatever is left of Mel Gibson's career completely imploding.

In the newest leaked recording, obtained by RadarOnline.com (WARNING: OFFENSIVE LANGUAGE), Gibson not only admits to hitting the mother of his 8-month-old daughter, Lucia, he also threatens ex-girlfriend Oksana Grigorieva's life – twice.

"You need a f---ing bat in the side of the head. Alright, how about that?" Gibson can be heard yelling after Grigorieva suggests that the actor needs to take medication. "You need a f---ing doctor. You need a f---ing brain transplant. You need a f---ing soul. I need someone who f---ing treats me like a man."

"You f--- my day up. You care about yourself when I have been so f---ing good to you. You're f---ing trying to destroy me," he rants. "Shut the f---k up! You should just f--king smile and b--w me because I deserve it!"

He goes on, "You have no f--king soul. I left my wife because we had no spiritual common ground. You and I have none, zero. You won't even f---king try. You don't care. You don't care."

The actor, who left his wife Robyn last year after 28 years of marriage, becomes so enraged during the phone conservation, he is left out of breath and heavily pants during the eight-minute recording.

"Don't you dare hang up on me! If you hang up, I'm coming over there," Gibson rants. Grigorieva threatens to call the police, to which Gibson replies, "You f---ing c---. You're in my house. I don't involve the police in anything because I stand up for myself."

Grigorieva goes on to explain that she is trying to protect their daughter, who she was holding when Gibson allegedly punched Grigorieva in the face.

"You were hitting a woman with a child in her hands? What kind of a man is that? Breaking her teeth twice in the face! What kind of man is that?" she asks in the recording.

Gibson begins to taunt her, saying, "Oh, you're all angry now! You know what, you f---ing deserved it!"

He retaliates to a perceived threat from Grigorieva with one of his own: "I'll put you in a f---ing rose garden you c--t! You understand that? Because I'm capable of it. You understand that?"

Gibson, 54, and Grigorieva, 40, filed dueling restraining orders against each other last month, and police are now investigating the dispute.

"An investigation of domestic violence was launched by [Los Angeles Sheriff's] Malibu/Lost Hills station detectives ... involving actor Mel Gibson and his former girlfriend Oksana Grigorieva," read a statement released Thursday. "The detective in charge of the investigation is currently gathering information regarding the allegations."

A new tape recording reveals a teary Oksana asking the 54-year-old actor what he thinks he is doing hitting her while she is holding their two-month-old child in early January.

According to RadarOnline.com, Oksana can be heard on the tape saying: “What kind of man is that who would hit a woman while she is holding a child in her hands, hitting her twice in the face? What kind of man is that?”

The ‘Braveheart’ star answers: “You know what – you f***ing deserved it.”

The allegations are the latest in a string of accusations by Oksana, who has also filed a restraining order against Mel.

Other recordings allegedly feature the two-time Oscar winner telling the Russian singer she looks like a “f***ing pig in heat”.

Mel has also sought a court order to stop the recordings being publically released, and to prevent photographs which apparently show the extent of the injuries he caused Oksana – he is alleged to have given her two black eyes and broken her front teeth.
